Do You Deserve Overtime Pay?
The Fair Labor Standards Act stipulates that employers must pay workers 1 1/2 times their regular rate of pay for each hour worked in a work week over the maximum allowed — generally, 40 hours. Employees must be paid a salary of at least $455 per week to be eligible for overtime pay, but are exempt if they act in one of the following capacities:
- Executive or managers: If you supervise the equivalent of two or more full-time employees, and have the discretion to hire and fire people or your recommendations to hire and fire carry weight with the employer you fall within this exemption.
- Professional: If you are in a profession that requires a lot of education and you are using what you went to school for you may be exempt. Includes doctors, lawyers and accountants.
- Administrative: Employees who perform nonmanual work with extensive independence and discretion with regard to matters of importance to a business or make important decisions about money. Includes chief financial officers.
